Trademarks

A trademark is a unique design, picture, emblem, logo or working (or combination) that is affixed to goods for sale that identifies the manufacturer as the product's source. Generic names for products or words that simply name the maker (without particular lettering) are not trademarks. The U.S. Patent Office registers trademarks to prove use and ownership. Using another's trademark (or one that is confusingly similar) is infringement and the basis for a lawsuit for damages for unfair competition and/or petition for an injunction against the use of the infringing trademark.
